Environmental Issues in Bankruptcy

The lawyers at Danning, Gill, Diamond & Kollitz, LLP, have a broad range of experience and familiarity with environmental issues which have been, or may be, raised in insolvency situations and bankruptcy proceedings. The range of experience includes an understanding of the interplay of federal and state laws, CERCLA and RCRA, within the framework of the Bankruptcy Code. This area of expertise covers issues such as the responsibilities of a debtor, debtor-in-possession or trustee, to comply post-bankruptcy with environmental laws, the dischargeability of environmental claims, the estimation of environmental claims, and the applicability of injunctive and other relief.

Sample Cases:
  - The Firm was retained by a trustee in bankruptcy to provide its expertise in the liquidation of a petroleum waste disposal business with two large storage and disposal sites in California. The Firm assisted the trustee in handling issues relative to the disposition in bankruptcy of petroleum waste and in evaluating the trustee's duties regarding the waste. This case involved coordinating with both State as well as municipal agencies, and the Firm was able to assist the trustee is successfully removing the burdensome property from the bankruptcy estate.
  - The Firm represented a trustee in bankruptcy in litigation over the right of a trustee to abandon a commercial property that had been the former site of a tire plant where there was a perceived environmental threat to the public.
  - The Firm has handled more discrete matters involving environmental issues in the operation of mobile home parks with septic tank waste issues, plating companies, jewelry manufacturing, and other users of environmentally sensitive materials.
  - A member of the Firm served as trustee in ten consolidated bankruptcy cases in which the trustee operated numerous gas stations, involving remediation and licensing issues.  The trustee handled numerous environmental issues and ultimately sold the gas stations.
